The Regular Meeting of the Alcoholic Beverage Control Board of the City of Annapolis was held on April 4, 2018 at 160 Duke of Gloucester Street. Chair Lawrence Harris called the meeting to order at 7:02 p.m.

Present: Lawrence Harris, Jr., Chair, Leonard Berman, Vice Chair, James Praley, Jr. and Matthew Zagwodzki Staff: Assistant City Attorney Elson and Deputy City Clerk Gaines

Vice Chair Berman moved to approve the Journal of Proceedings of March 7, 2018. Seconded. CARRIED on voice vote.

➢ Approval of a Management Agreement- Hospitality Associates Inc. t/a O’Brien’s Oyster Bar & Restaurant (Liquor License Holder) and Grillfish, LLC t/a O’Brien’s Oyster Bar & Restaurant(Manager)

Daniel Mellin, attorney for the applicant, Hillman, Brown & Darrow, P.A., 221 Duke of Gloucester Street, Annapolis, Maryland 21401 gave a brief presentation.

Chair Harris entered the following into the record:

Exhibit #1: Executed Management Agreement

Applicant Alexakis Konstantinos, 952 Old County Road, Severna Park, Maryland 21146 was present and answered questions addressed by the Board.

Present and testified on behalf of the application: Steve Ploof- 183 Green Street, Annapolis, Maryland 21401 Peter Miller-171 Green Street, Annapolis, Maryland 21401 (Read into the Record by Neighbor)

No one (else) from the general public spoke in favor of, or in opposition to the application.

Member Zagwodzki moved to approve the management agreement between. Hospitality Associates Inc. t/a O’Brien’s Oyster Bar & Restaurant (Liquor License Holder) and Grillfish, LLC t/a O’Brien’s Oyster Bar & Restaurant (Manager) Additionally, the Board finds no evidence of subterfuge pursuant to 7.12.180.Seconded. CARRIED on voice vote.

➢ New License- Grillfish, LLC t/a O’Brien’s Oyster Bar & Restaurant

Application has been made for a new Class B-4.x.a

Chair Harris moved to make a conditional approval based on receipt of satisfaction of indebtedness against the application for a new, Class B-4.x.a. Seconded. CARRIED on voice vote.

Chair Harris declared the public hearing closed.

Application has been made for an Expansion of an existing Class B-2

Phillip Dales, attorney for the applicant, Linowes and Blocher, LLP, 7200 Wisconsin, Avenue, Suite 800, Bethesda, Maryland 20814-4842 gave a brief presentation.

Member Praley moved to approve the expansion of an existing license Class B-2. Seconded. CARRIED on voice vote.

Member Praley moved to approve the application for a Special Class C, One Day Liquor License for Beer, Wine and Liquor (including live music) to the Naval Academy Athletic Association from 7:00 p.m. to 9:30 p.m., on April 21, 2018. Seconded. CARRIED on voice vote.

Member Praley moved to approve the application for a Special Class C, One Day Liquor License for Beer, Wine and Liquor (including live music) to the Naval Academy Athletic Association from 7:00 p.m. to 9:30 p.m., on June 2, 2018. Seconded. CARRIED on voice vote.

Member Praley moved to approve the application for a Special Class C, One Day Liquor License for Beer, Wine and Liquor (including live music) to the Naval Academy Athletic Association from 7:00 p.m. to 9:30 p.m., on June 16, 2018. Seconded. CARRIED on voice vote.

Member Praley moved to approve the application for a Special Class C, One Day Liquor License for Beer, Wine and Liquor (including live music) to the Naval Academy Athletic Association from 7:00 p.m. to 9:30 p.m., on April 14, 2018. Seconded. CARRIED on voice vote.

Applicant Dennis Coughlin, 308 Linden Avenue, Annapolis, Maryland 21401 was present and answered questions addressed by the Board.

Member Zagwodzki moved to approve the application for a Special Class C, One Day Liquor License for Beer, Wine and Liquor (including live music) to Maryland Hall for the Creative Arts from 6:30 p.m. to 9:30 p.m., on April 13th & 14th 2018. Seconded. CARRIED on voice vote.

Applicant Dennis Coughlin, 308 Linden Avenue, Annapolis, Maryland 21401 was present and answered questions addressed by the Board.

Member Zagwodzki moved to approve the application for a Special Class C, One Day Liquor License for Beer, Wine and Liquor (including live music) to Maryland Hall for the Creative Arts from 6:30 p.m. to 9:30 p.m., on May 4th & 5th 2018. Seconded. CARRIED on voice vote.

Request for Special Class C, One Day Liquor License

Applicant Paul Jacobs, 3442 Rockway Avenue, Annapolis, Maryland 21403 was present and answered questions addressed by the Board.

Member Praley moved to approve the application for a Special Class C, One Day Liquor License for Beer, Wine and Liquor (including live music) to the Annapolis Maritime Museum from 12:00 p.m. to 6:30 p.m., on April 20th, 21st, and 22nd 2018. Seconded. CARRIED on voice vote.

➢ Substitution of Officer- Bella Italia Pizzeria & Restaurant

Maddalena Assante to replace Judy A. Breth-Smith

Rex Caldwell, attorney for the applicant, 1610 West Street, Suite 205, Annapolis, Maryland 21401 gave a brief presentation.

Applicant Maddalena Assante, 707 Mill Creek Road, Arnold, Maryland 21012 was present and answered questions addressed by the Board.

Member Praley moved to approve the substitution of Maddalena Assante as an officer on the alcoholic beverage license of Bella Italia Pizzeria & Restaurant Seconded. CARRIED on voice vote.

➢ Substitution of Officer- Ledo’s Pizza & Pasta

Joan M. Mason to replace Judith Blank

Curtis Noland, Vice President 1505 Marlin Lane Huntington, Maryland 20639 gave a brief presentation.

Applicant Joan M. Mason, 1216 Beaver Tree Drive, Odenton, Maryland 21113 was present and answered questions addressed by the Board.

Member Praley moved to approve the substitution of Joan M. Mason as an officer on the alcoholic beverage license of Ledo’s Pizza & Pasta. Seconded. CARRIED on voice vote.

➢ Substitution of Officer- Harvest Wood Grill & Tap

Mary Ware to replace Betty E. Chenowith

Jacob Garner, representing Harvest Wood Grill & Tap, 26 Market Space, Annapolis, Maryland 21401 gave a brief presentation.

Applicant Mary Ware, 1117 Brassie Court, Arnold, Maryland 21012 was present and answered questions addressed by the Board.

Member Praley moved to approve the substitution of Mary Ware (Patrick Ware has power of Attorney) as an officer on the alcoholic beverage license of Harvest Wood Grill & Tap Seconded. CARRIED on voice vote.

➢ Extension of Licensed Premises during a Special Event- 1st Sunday Arts Festival

Request for an expansion of licensed premises with Consumption of Alcoholic Beverages on City Property during the 1st Sunday Arts Festival scheduled on the 1st Sunday of Each month from May to December 2018.

Eric Evans, Executive Director of the Inner West Street Association, P.O. Box 6295 Annapolis, Maryland 21401 presented the request and answered questions addressed by the Board.

Member Praley moved to approve the request for an extension of licensed premises during a special event to Rams Head Tavern, Stan & Joe’s Saloon, Luna Blu, El Toro Bravo, 49 West Coffeehouse and Tsunami from 11:00 a.m. to 5:00 p.m. on the 1st Sunday of Each month from May to December 2018. Seconded. CARRIED on voice vote.

➢ Extension of Licensed Premises during a Special Event- Dining Under the Stars

Request for an expansion of licensed premises with Consumption of Alcoholic Beverages on City Property during the Dinner Under the Stars Series scheduled on the Wednesday Evenings May 30th to September 19th 2018 from 6:00- 10:00 p.m.

Eric Evans, Executive Director of the Inner West Street Association, P.O. Box 6295 Annapolis, Maryland 21401 presented the request and answered questions addressed by the Board.

Vice Chair Berman moved to approve the request for an extension of licensed premises during a special event to Rams Head Tavern, Stan & Joe’s Saloon, Luna Blu, El Toro Bravo, 49 West Coffeehouse and Tsunami from 6:00- 10:00 p.m. on Wednesday Evenings May 30th to September 19th 2018. Seconded. CARRIED on voice vote.
