Statement: Pursuant to the requirement of the Annotated Code of Maryland, General Provisions Article Section § 3-305 (b)

The Board of Appeals held a special meeting at 7:00pm, Wednesday, February 21, 2018 in City Council Chambers, 160

Duke of Gloucester Street.

Members Present: Chair Robert Gallagher, Andrew Burnett, Michael Walsh, Christian Zazzali

Others Present: Pete Gutwald-Director, Gary Elson-Counsel to Board, Tami Hook-Recorder

Mr. Walsh moved to close this session of the Board of Appeals meeting for the purpose of consulting with counsel to obtain legal advice on a legal matter at 7:11pm. Mr. Burnett seconded the motion. The motion to close the session was approved unanimously in a vote of 4-0.

The authority under which the session was closed was the Annotated Code of Maryland, General Provisions Article, Section § 3-305(b)(7). The topic of discussion was regarding a prior decision of the Board of Appeals on an appeal from the Director of Planning and Zoning.

Mr. Burnett moved to adjourn the closed session at 8:03pm. Mr. Walsh seconded the motion. The motion passed unanimously in a vote of 4-0.

Mr. Zazzali moved to open the regular session. Mr. Burnett seconded the motion. The motion passed unanimously in a vote of 4-0.

Mr. Zazzali moved to reopen the hearing on Noreast Holdings, LLC, to allow for public testimony and further arguments of the parties. Mr. Walsh seconded the motion. The motion passed unanimously in a vote of 2-0 (Gallagher and Burnett did not vote)

Adjournment

With there being no further business, Mr. Zazzali moved to adjourn the meeting at 8:10pm. Mr. Burnett seconded the motion. The motion passed unanimously in a vote of 4-0.
