City of Annapolis Alcoholic Beverage Control Board met Nov. 7.

Here is the minutes provided by the board:

Chair Lawrence Harris called the meeting to order at 7:00 p.m.

Present: Chair, Lawrence Harris, Vice Chair, James Praley III, Member Kia Baskerville And Member, Dick Peterson

Staff: Assistant City Attorney Elson, Deputy City Clerk Gaines

Member Praley moved to approve the minutes of October 3, 2018. Seconded. Carried on voice vote.

 Disciplinary Hearing- Sakura Café- 105 Main Street, Annapolis, Maryland 21401 Infraction Citation No. C-1950, hours of service

The charges were not disputed by the establishment.

Ofc. Dekowsky presented the case for the City of Annapolis.

Licensees, Ellen A. Mignone, 19-A Lafayette Ave. Annapolis, Maryland 21401, Jie Wu- Liu, 3306 Hollow Court, Elliott City, Maryland 21043 and Huiyee Lung Harrison, 400 Jumpers Hole Road, Severna Park, Maryland 21146 were present and answered questions by the Board.

Chair Harris declared the disciplinary hearing closed.

 Action on Disciplinary Hearing- Sakura Café- 105 Main Street, Annapolis. Maryland 21401

Vice Chair Praley moved that the facts presented at the hearing on November 7, 2018 warrant a violation as charged. Seconded. CARRIED on voice vote.

Following a discussion, Member Baskerville moved to impose a 14-Day suspension of Sakura Café’s liquor license beginning on November 21, 2018 and ending on December 4, 2018 and an imposed fine of $1, 800.00 for this violation payable by 4:00 p.m. on Friday, December 21, 2018. Seconded. CARRIED on voice vote.

 Disciplinary Hearing- El Rincon Latino Bar & Grill- 1313 Forest Drive, Annapolis, Maryland 21403

Infraction Citation No. C-1951, hours of service.

The charges were not disputed by the establishment.

Ofc. N. Moore presented the case for the City of Annapolis.

Brian Lyman, attorney of Hillman, Brown & Darrow P.A., 221 Duke of Gloucester Street, Annapolis, Maryland 21401 on behalf of the licensees waived their right to hear charges presented by Ofc. Moore.

Licensees Brenda Figueroa,101 Second Street, Annapolis, Maryland 21403 and Veronica Quintanilla, 126 Brightwater Drive, Annapolis, Maryland 21403 present and answered questions by the Board.

William Vasquez, manager was also present.

Chair Harris, declared the disciplinary hearing closed

 Action on Disciplinary Hearing- El Rincon Latino Bar & Grill-1313 Forest Drive, Annapolis, Maryland 21403

Member Baskerville moved that the facts presented at the hearing on November 7, 2018 warrant a violation as charged. Seconded. CARRIED on voice vote.

Following a discussion, Member Baskerville moved to impose a fine for this violation of $500 payable by 4:00 p.m. on December 21, 2018. Seconded. CARRIED on voice vote.

Public Hearing

 Expansion – Annapolis Yacht Club- Eastport Properties Inc.

C. Edward Hartman, III, attorney for the applicants, requested that the submitted application for an expansion be amended to an application for a new alcoholic beverage license Class F Beer, Wine and Liquor to include the Sailing Center and Family Activity Center, for the premises known as the Annapolis Yacht Club Eastport Properties Inc., Annapolis, Maryland 21401.

C. Edward Hartman, III, attorney for the applicants, representing Hartman Attorneys at Law, 116 Defense Highway, Suite 300, Annapolis, Maryland 21401 gave a brief presentation.

Brian Asch, General Manager, 5 Stewart Way, Severna Park, Maryland 21146 and Jim Ellis, Commodore, 312 Severn Avenue, Annapolis, Maryland 21403 were present to answer questions from the Board.

Chair Harris entered the following into the record:

Spoke in favor of/opposition to/the application:

Harold Sherman, 301 Burnside Street, Annapolis, Maryland 21403

No one (else) from the general public spoke in favor or in opposition to the application.

Member Peterson moved to approve an amended application for a new Class F, Beer Wine and Liquor alcoholic beverage license contingent on receipt of an amended new application with associated documents for the property known as the Annapolis Yacht Club Eastport Properties located at 314 Sixth Street and 510 Severn Avenue, Annapolis, Maryland 21403. Seconded. CARRIED on voice vote.

Chair Harris declared the public hearing closed.

 Proposed Amendment- 2.4 D

Member Peterson moved to approve proposed amendment to 2.4(D) Hearings and the change of all Article 2B references to the Alcoholic Beverages Article (AB) throughout of the City of Annapolis Alcoholic Beverage Control Board Rules and Regulation. Seconded. CARRIED on voice vote.

Business and Miscellaneous

 Special Class C, One Day Liquor License – Orphan Grain Train- Annapolis Running Classic

Request for Special Class C, One Day Liquor License

Applicant, Craig Harrison and Lisa Fountain, Event Directors was present and answered questions addressed by the Board.

Vice Chair Praley moved to approve the application for a Special Class C, One Day Liquor License for Beer, Wine and Liquor (including live music) to the Orphan Grain Train from 7:15 a.m. to 5:30 p.m., on Saturday, November 10, 2018. Seconded. CARRIED on voice vote.

Upon motion duly made, seconded and adopted, the meeting adjourned at _ 9:15_p.m.
